Under the federal system there are a number of crimes, drug offense being one of them, where there is a presumption that you are a flight risk, and a danger to the community. The burden is then place on you, before you are even convicted, to show otherwise. If you can't, you could be held without bail In State Court the burden is on the prosecution to show why you should not have bail set. That is why in State Courts, even someone charged with Murder will have some type of bail set, where a person charged with a much less serious drug charge could be held without bail across the street in Federal Court. |
