Threatening

 

Felony threatening in Hawaii is caused by threatening more than one person, or threatening that person with a weapon, or doing so on more than one occasion.  Recently, the prosecutor's office have been charging a lot of persons with this offense in domestic situations.  For instance, if I get in a fight with my wife and she calls the police and says I threatened her with a knife during the argument, the police would arrest me for felony threatening, despite the fact that there are no other witnesses.

Suffice it to say that such weak cases are often lost by the prosecutor's office.  However, even if they lose, they will cause a serious disruption to the person's life.  Usually, if domestic violence is alleged, the initial bail on these cases is $25, 000.00.  There is also a potential 5 year jail term if convicted.
