Negligent Homicide

 

Negligent Homicide carries a maximum possible jail sentence of between one and ten years. This case normally follows someone’s death resulting from a traffic accident. The exact charges depend on a number of factors including whether alcohol was involved.

We have represented a number of people for this offense in the past. Usually we have to look closely at the accident to try to determine if our client’s negligence caused it, or whether the alleged victim was in fact the cause of the accident. Recently, the prosecution has been charging Manslaughter instead of Negligent Homicide if a person has a prior DUI conviction. The police almost always release people "pending investigation" and later seek an Indictment in these types of cases.
