Using a Firearm in the Commission of a Felony carries a mandatory twenty year jail term if convicted as charged. It usually accompanies another underlying felony charge. We have represented people charged with this offense in past. This type of charge was ruled illegal by the appellate court several years ago. However, the legislature tried to fix the problems by rewriting the statute. Now the courts say it is legal. As a result, the prosecution regularly will add these charges to other crimes where a gun is used. |
