HIGHLY INTOXICATED

 

Beginning July 1, 2007 a new law goes into effect for "highly intoxicated" DWI offenders.  Basically, if a person's blood or breath alcohol level is .15 or higher they are classified as a "highly intoxicated" offender.  This new law calls for a minimum 6 month absolute license suspension on a first offense.  That means no work permit.

Even though the law calls for a 6 month absolute revocation of your license, most of the time I am able to get you a work permit.  That is because there are numerous witnesses need to prove you were highly intoxicated.  More often than not, all the necessary witnesses don't show and the case can get knocked down to a regular DUI case.  As such you would then be able to qualify for a work permit and not lose your license plates and registration.  The best part of this is that once you get a work permit from the revocation office, the court can't touch your license anymore, even if you lose as a highly intoxicated driver.
